The Booking: Your contract is with Active Adventure South West (hereinafter called 'we or us'). These booking conditions together with the details on our website form the basis of your contract with us. When booking a course, a contract is made when we confirm the booking in writing. The person making the booking and signing the booking form (hereinafter called 'you' or 'the client'?) accepts responsibility for payment for the booking. You are also responsible for ensuring that all other persons attending the event read these booking conditions and are fully aware of the booking conditions and course details and requirements. All participants will be the responsibility of the client during the activity and any consent will be your responsibility to obtain. We do not accept any liability for any loss caused by failure to complete the declaration.
Payment: A deposit of 50% is payable at the time of booking. The balance is due four weeks before the course start date. If you book less than four weeks before the event, the full balance must be paid at the time of booking. Final reminders will not be sent and if the balance is not received by the payment date detailed on the confirmation receipt we reserve the right to re-allocate/cancel the event.
Behaviour and risk: All participants must sign a waiver stating they are able to participate in the activity and will behave in manor that will not place themselves or others and staff at risk. No alcohol or drugs will be tolerated and anyone who appears impaired by either drugs or alcohol will be removed from the activity and no refunds issued.
Under 18’s must have a parent / guardian consent form signed before participating.
Changing your booking: We will make every effort to arrange any changes you request after the booking has been confirmed, providing it is more than 21 days before the course start date. If we receive notification less than 21 days before the course start date an administration charge equivalent to the deposit of 25% of the event cost will be incurred. Any changes are subject to availability of dates.
Cancellations: Should you need to cancel your booking once it has been confirmed, we must be notified in writing by the person making the booking. The date on which written notification is received by us will determine the level of cancellation charges applicable. Charges will be levied at the following percentages of total cost:

No discount or reduction in fees will be made if the weather or other conditions outside the control of Active Adventure South West preclude all or part of the event taking place.
If Active Adventure South West fails to attend or cancels under no circumstances will consequential losses be met. Concerned hirers are advised to take out insurance to cover this eventuality.
Course participation, Liability and Other Important Information: The activities carry with them a degree of risk both to people and property, even if enjoyed under proper supervision by qualified instructors. They are also strenuous activities that require those taking part to have a reasonable standard of fitness. You must therefore make us aware of any medical conditions, illnesses or allergies you have and any prescribed medication you are taking on the booking form at the time of booking and to your instructor prior to the event start.
For course participants under 18 years old it is the responsibility of the parent or guardian to inform us of any medical conditions. You should not participate in any activity or event if you are suffering from a heart condition or any other injury / illness which may affect you physical ability or if you are pregnant and must in no circumstances be under the influence of any alcohol or illegal drugs. Also, you must not be under the influence of medication which may adversely affect your physical abilities. You must agree to abide to all instructions and decisions that Active Adventure South West and our instructors make in order to secure the safety and comfort of all participants. You will have the use of Active Adventure South West equipment during your event. Whereas we take all reasonable measures to ensure the safety and good condition of that equipment, you are responsible for immediately reporting any damage caused to the equipment or which becomes apparent whilst the equipment is in your possession. Active Adventure South West does not seek to limit or exclude any liability for personal injury or loss of life to participants which may occur as a result of its own negligence or that of our employees. However, Active Adventure South West assumes no liability in respect of any personal injury loss, damage, consequential loss or third party claims which occur through no fault of our own or caused by the negligence of you or one of the participants in your group.
Age restrictions:
We follow governmental recommendations for outdoor activities and the Adventure Activities Licensing Service regulations that state that children under 8 years old are not permitted to take part on Licensable activities.
Skate park bookings require children under 11 to be supervised by an adult and under 18’s to sign a waiver.
Weather conditions:
In the rare event that Active Adventure South West or our employees consider the weather conditions to be unsuitable for the event we will give a credit voucher for any event cancelled by us. Credit vouchers can be used within one year from the date of the missed lesson. Any events owed are subject to availability and must be booked up to 14 days in advance. We require a new booking form to be completed for credited lessons and all credit vouchers are non-transferable.
Website accuracy:
Whilst every effort is made to ensure the accuracy of escapexsports website, it is intended only as a guide to the services it provides. We are relieved of any liability due to any errors or omissions it may contain, or any minor discrepancies between the website's content and that service.
Images:
Any likeness or image of you secured or taken on any of our events may be used by us without charge in all media for genuine promotional or marketing purposes. This includes promotional materials of any kind, such as brochures, leaflets, videos and the internet. If you would prefer not to be used in any promotional materials please inform us in writing prior to your course.
Prices:
Although every effort is made to ensure prices are accurate at the time of going to press, price fluctuations due to circumstances outside our control can occur. Any changes will be made clear at the time of booking.
Skate Park and Event bookings:
Active Adventure South West personnel will deliver the equipment to site and erect it. They will also dismantle the equipment at the end of the hire period and remove it from the site.
A suitable area for the erection for the equipment is required.:-
Skatepark – We recommend this is a level area of tarmac or concrete 20m X 20m minimum in size. For use only with BMX bikes firm smooth grass is suitable. Escapexsports staff will have the final say in the suitability of the site for safety reasons. If access is limited or you are unsure of the suitability of the site please discuss it with us before booking.
Half pipe - We recommend this is a level area of tarmac or concrete 10m X 15m minimum in size. Active Adventure South West staff will have the final say in the suitability of the site for safety reasons. If access is limited or you are unsure of the suitability of the site please discuss it with us before booking.
The event organiser is responsible for ensuring that there are suitable crowd control arrangements in order to keep the viewing audience at least 3m from the edge of equipment.
Skateparks / Half pipes:
Users of the skatepark must use appropriate safety equipment. Active Adventure South West agrees to supply for use during staffed events such safety equipment. Helmets must be worn by all participants. Knee and elbow pads will be provided and must be worn by all participants. Please advise us if your organisation has a policy on safety equipment.
Un staffed skatepark rentals i.e. With supervision staff provided by the hirer, are without equipment, unless specifically agreed in writing at the time of booking. All equipment used must conform to industry safety guidelines. Escapexsports can take no responsibility for the hirer's equipment. Erection/dismantling of the skatepark must only be carried out by trained and appointed persons. Please ask at the time of booking if you are likely to require such training.
The hirer is responsible for insurance during un staffed rentals, both for the activity and replacement of the skatepark. The skatepark has a replacement cost of £40,000 plus VAT.
If Active Adventure South West supplies staff for the event they will be suitably trained, CRB checked (if appropriate) and at least one will have a current first aid qualification.
Our aim is to allow all to experience skating on the skate ramps but Active Adventure South West retain the right to limit participation for safety or other reasons.
Active Adventure South West has in place Public Liability Insurance (£5 Million) .

Law and Jurisdiction:
These conditions form a contract between us which will be construed in accordance with English Law and it is agreed between us that each will submit to the jurisdiction of the English Courts.
